general conditions OF SALE
Please read carefully the following general sale conditions defining the agreement which governs the relations between JMO Aventures and
the client during and after the reservation or the provision of the services offered by JMO Aventures.
RESERVATION & confirmation :
The client is bound by his/her reservation request as soon as he validates his confirmation. After making an order, a contract is sent to you by JMO Aventures Company. The contract must be sent back to us so that we can validate your reservation. Reservations are made upon request, as available, between 15 days and one month prior to the date of departure for some special and faraway destinations as well as for certain products tours / cruises). Some packages include restrictions on the minimum / maximum number of nights in a hotel room, on periods of expositions, on high seasons …
The registration is confirmed only by the payment of a 50% advance on the overall trip cost. The full payment must be made before the date of departure within the deadline fixed according to each product, which deadlines we shall communicate to you. Any client failing to pay on the date mentioned in the contract shall be considered to have cancelled his trip without any possibility for him to claim any reimbursement.
METHODS OF PAYMENTS :
The methods of payment shall be specified on your contract.
VISA FORMALITIES AND HEALTH MEASURES:
Since the agency is not in charge of obtaining visas, clients are advised to get information from concerned embassies / consulates on how to obtain a visa as well as to the necessary health measures particularly concerning vaccines. Clients are also advised to have all their travel documents ready before they make their final reservations.
PRICE :
The prices are subject to the exchange rate variations, to the increase in transport costs …etc
Except when provided for in writing by us, the prices do not include the processing fees (administrative and health processing), tips, drinks, all personal expenses during your trip, transfers and excursions. To the all inclusive price, airport taxes and the processing fees must be added.
JMO Aventures undertakes to strictly provide, as far as it can, the services as ordered by the concerned party.
The indicated prices were determined in January 2008 according to the following economic data : transport costs linked principally to :
· The cost of fuel
· The exchange rate applied to the related trip or stay
dISCOUNTS FOR CHILDREN AND BABIES :
Children and babies benefit from discounts when these are offered by air companies, hotels and service providers. These discounts are set in accordance with the price list of each air company, as well as with the accommodation policy adopted by each hotel and each service provider.
PROCESSING fee:
It is 7 € per person, not included in the reservation fees and/or file routing fees which may sometimes be required for some destinations and /or providers.
ACCOMMODATION:
The quality of accommodation in Morocco is getting better and better but varies depending on the regions. Remember that the criteria for hotel classification are set by competent local authorities and that they are different from those of other countries. Some hotels vie with some prestigious international establishments, like La Mamounia in Marrakech, Sofitel Palais Jamai in Fez. 5 star, 4 star and 3 star hotels offer comfort and service matching the fee they charge.
The hotel facilities located in the small villages of the Atlas or the Great South do not offer a wide range of choices. Therefore, one must content themselves with the available facilities of which one cannot expect a level of comfort, service and cleanliness almost equal to that of the metropolitan hotels existing in the country. It is difficult in these barren areas, with excessive climatic variations, to upkeep some establishments destined to receive clients on a daily basis; nevertheless, the establishments try hard to offer good quality services and to meet the needs of the clients.
Generally speaking, clients cannot check in until 14h on the day of arrival and must check out at mid-day on departure day.
If accommodation in a triple or quadruple/ or a cabin allows you sometimes to make some savings on a supplementary « single» or to take advantage from « discount child sharing parents’ room” , you have to know that these are generally double rooms or cabins in which a supplementary bed is added, thus making them less spacious.
cancellation and change :
Any cancellation made by client entails variable costs payment depending on the nature of the trip and the date on which said cancellation has been made. Each package comprises cancellation and modification fees specific to it.
The client may by no means modify or cut the services contained in his trip without a prior agreement from JMO Aventures. Therefore, the modification fees are entirely at his charge without any possible claim for a repayment for the services he did not benefit from due to those modifications.
The cancellation, whenever it occurs, does not waive one from the payment of the overall amounts due. No repayment proceeding is started except under this condition. All cancellations must be notified in writing to JMO Aventures either by registered mail or exceptionally by facsimile or email if the deadline is too short before the date of departure.
CLAIMS , LOSSES & DEterioraTIONS :
To be accepted, all claims must be addressed to our Top Management, by registered mail, joined with all supporting documents or exceptionally in cases of emergency by email at: direction@SAHARA-aventures-4x4.com within a time limit not exceeding30 days after the date of return from the trip. Our response depends on the time our investigation takes as far as the involved services are concerned. However, JMO Aventures will do its best to respond ASAP. Make sure you provide us with all the supporting documents.
In case the luggage entrusted to an air company is lost or deteriorated, a complaint must be made by the concerned person to the airport/company’ authorities right after noting the loss or deterioration.
During your trip, we recommend you not to leave unguarded your valuables or jewelleries which you may leave with the hotel receptions. JMO Aventures cannot be held liable neither for thefts of valuables and jewelleries nor for the luggage loss or deterioration.
Insurance:
No insurance is included in our packages. JMO Aventures highly recommends you to subscribe to an insurance policy that covers you before, during and after your trip.
possible package modifications :
The tour, hike and excursion stages… may be modified without prior notice for reasons that are beyond our control, mainly because of official visits, cultural and political events, weather conditions, strikes. The same thing applies to the flight date. In this case, price modification may be applied.
Should any such programme modification occur, JMO Aventures undertakes to inform its clients as soon as possible.
role of the travel agency :
Being only an intermediary authorized by air companies on the one hand and by hotels and service providers on the other hand, the travel agency can only assume claims that are within the range of its direct responsibility.
professional LIAbility insurance
SANAD insurance company, 181, Boulevard d’Anfa , 20 000 – Casablanca , covers the financial consequences of the Professional Civil Liability which JMO Aventures might incur because of personal injury, pecuniary and non pecuniary loss, caused to its clients in Morocco.
COMPETENT JURISDICTION :
For all disputes resulting from the interpretation or the execution of the foregoing, jurisdiction is hereby granted to the Commercial court of Casablanca only.
